The Italian Supreme Court, with judgement no. 14944/2024, stated that cannot be considered unfair competition the conduct of an entrepreneur, who starts a professional collaboration with a worker who has terminated the previous employment relationship and has disregarded the obligation to give notice or the non-competition clause with the former employer; this is because, in principle, the entrepreneur who recruits the resigning worker is not bound to respect the agreements with the former employer.
